We are still waiting on the entry of a judgment and claims for attorney’s fees, but in February of 2019, Frank Lyon and I were successful in defending our client in a shareholder derivative lawsuit alleging the founder breached his fiduciary duty to his company by providing no value for the compensation he received.   Both the company CEO and the founder were exceptional witnesses, thanks to Robert Swafford.   The plaintiff had a difficult time articulating the basis of his claim, even after having several years to think about it.  It was a great pleasure trying a lawsuit with Frank.  He hired me out of law school in 1988 when he worked in the Austin office of Midland-based Lynch, Chappell & Alsup
